SPORTUP TERMS & CONDITIONS (2025 UPDATE)
Effective from: 14/11/2025
SportUP Sunshine Coast Pty Ltd (“SportUP”, “we”, “our”, “us”) operates adult-only social sporting competitions across Queensland. By registering a Team, registering as an Individual for a full season, attending a venue or participating in any SportUP activity, you agree to these Terms & Conditions.
1. Captain Responsibilities
1.1 Age Requirement - 18+ Only
- All participants must be 18 years of age or older.
- Under-18 players will be removed immediately with no refund.
1.2 Player Sign On
- All players must be registered through the SportUP App before participating.
1.3 Season Commitment & Fees
For Teams:
- Registering commits you to a 12-round season.
- The $105 deposit is non-refundable.
- All season fees are non-refundable.
For Individual Registrations:
- Full-season fees are paid upfront.
- Fees are non-refundable once registration is confirmed.
1.4 Forfeits & Substitutes
- A $99 forfeit fee applies if a Team fails to attend its scheduled game.
- To avoid the fee:
- Post in the Subs Group before 1pm, and
- Contact SportUP on 0433 298 224 before 1pm if still short.
- Post in the Subs Group before 1pm, and
- If subs are found and the game proceeds, no fee applies.
1.5 Insurance Requirement
- All players must hold personal insurance appropriate for the sport.
- Participation is strictly at your own risk.
2. Player Responsibilities
2.1 Conduct & Behaviour
Players must:
- Play in a friendly, social spirit
- Respect referees, staff and other players
- Avoid aggression, swearing or abusive behaviour
- Comply with all rules and referee instructions
2.2 Venue Rules (School Venues)
Players must:
- Not enter early or stay late
- Use approved entry/exit points
- Avoid alcohol, littering or disruptive behaviou
- Not bring pets onsite
SportUP may remove players or Teams who breach venue rules.
3. Definitions
- Team – a group registered collectively for a season.
- Individual Registration – a player who registers independently for a full season.
- Athletic Activities – all social sports activities run by SportUP.
- Injury – any physical, mental or emotional injury including sprains, strains, concussion, fractures, dehydration, heat illness, cardiac events, or bruising.
4. Refunds, Credits & Cancellations
4.1 General Refund Position (Teams & Individuals)
Team deposits, Team fees and Individual Registration fees are non-refundable, except where required by the Australian Consumer Law (ACL).
Refunds are not provided for:
- change of mind
- injury or illness
- personal commitments
- inability to field a full team
- individual absences
- missed or rescheduled games
4.2 Forfeits, Misconduct & Withdrawals
No refunds or credits apply for:
- forfeits
- misconduct removals
- ejections
- team withdrawals
- player absences
4.3 SportUP Happiness Guarantee (First-Time Teams & First-Time Individuals)
If you don’t love your first ever scheduled SportUP game, as a Team or as an Individual, and you notify us within 24 hours, we will:
- Find you a better-fitting competition, OR
- Give you your money back.
This guarantee applies only:
- to your first ever scheduled SportUP game, and
- when notification is received within 24 hours.
4.4 Minimum Game Guarantee – 11 Games
For a 12-round season, SportUP guarantees a minimum of 11 games for:
- Full-season Team registrations
- Full-season Individual Registrations
If fewer than 11 games are delivered due to SportUP’s inability to resupply, you will receive a pro-rata credit per missed game.
This guarantee excludes:
- forfeits caused by the Team
- individual absences
- refusal to attend a rescheduled time
- late-season or mid-season registrations
4.5 No Pro-Rata Refunds for Late or Mid-Season Registrations
Teams or Individuals joining after Round 1:
- pay a rate set by SportUP
- are not entitled to pro-rata refunds
- are not eligible for the 11-game guarantee
4.6 Season Cancellations or Material Changes
If SportUP cancels a full season or cannot deliver the service at all, we will provide a:
- credit, or
- refund for the cancelled portion only,
as required under the ACL.
Normal operational changes do not qualify for refunds:
- weather delays
- venue changes (within reasonable distance)
- fixture time adjustments
- school closures
- temporary operational changes
4.7 Injury Credit (Goodwill Only)
SportUP may, at its discretion, offer:
- A one-time injury credit for Individual Registrations
- Only if injured before Week 3
- With reasonable evidence supplied
This credit:
- is discretionary
- non-transferable
- valid for 24 months
- not guaranteed
4.8 Credit Terms (Teams & Individuals)
Credits issued by SportUP:
- expire after 24 months
- cannot be exchanged for cash
- are non-transferable
- must be used for future SportUP competitions
4.9 ACL Requirements
Where the ACL requires a remedy, SportUP will choose to:
- re-supply the service,
- provide an equivalent credit, or
- refund the portion of the service not provided.
4.10 Discretionary Decisions
All credit and refund decisions are made in compliance with ACL.
Where a refund is not legally required, SportUP may still offer a credit at its discretion.
5. Disclaimer of Liability
To the fullest extent permitted by law, SportUP and its owners, directors, volunteers, referees, staff and contractors (“the Releasees”) are not liable for any injury, death, loss or damage suffered during participation.
Participants acknowledge:
- Social sports involve inherent risks
- Injuries may occur from collisions, falls, equipment, venue conditions or player actions
- Not all risks can be eliminated
6. Assumption of Risk, Release & Indemnity
6.1 Assumption of Risk
You voluntarily participate with full knowledge of potential risks.
6.2 Release
To the maximum extent permitted by law, you release the Releasees from all claims, liabilities and demands arising from participation, including negligence.
6.3 Indemnity
You indemnify the Releasees against:
- third-party claims
- medical or ambulance costs
- property damage caused by your actions
6.4 ACL Limitation
Nothing in this document excludes non-excludable ACL rights.
Where permitted, SportUP limits liability to:
- re-supplying the service, or
- covering the cost of re-supplying the service.
7. Privacy & Data Handling (2025 Reform Ready)
SportUP complies with the Privacy Act 1988 (Cth) and upcoming Privacy Reforms.
7.1 Information We Collect
- contact details
- registrations
- emergency info
- payment detail
- attendance & participation data
- photos & videos
7.2 How We Use Information
- running competitions
- safety & incident response
- communication
- SportUP App functionality
- marketing (opt-out available)
7.3 Third-Party Providers
We may share data with:
- referees, venue staff
- IT & app platforms
- payment processors
- emergency services
7.4 Your Rights
You may request:
- access
- correction
- deletion (when legally permitted)
- marketing opt-out
7.5 Retention
Data is stored securely and retained only as required for operations, safety and legal obligations.
8. Governing Law
These Terms are governed by Queensland law.
Any disputes must be resolved in a Queensland court.
9. Acceptance of Terms
By registering a Team or Individual Registration, participating in games or entering a SportUP venue, you acknowledge and agree to:
